The Supreme Court’s conservative majority showed support on Wednesday for Tennessee’s law restricting gender transition care for minors. Chief Justice John Roberts emphasized the role of legislatures over courts in addressing medical debates.

Tennessee’s 2023 law, SB1, prohibits puberty blockers and hormone therapy for those under 18 experiencing gender dysphoria.

The state argues it wants to encourage minors to “appreciate their sex, particularly as they undergo puberty” and that gender transition treatments “might encourage minors to become disdainful of their sex.”

Justice Ketanji Brown Jackson warned this approach could neglect constitutional responsibilities. Critics argue that the ban discriminates based on sex, violating the Equal Protection Clause.

The Biden administration, families, and a doctor argue the law violates constitutional protections, including equal protection based on sex and transgender status.

Supporters claim the law ensures medical caution, aligning with some European nations scaling back similar treatments.
