A new 165-page filing from Special Counsel Jack Smith reveals that after learning about the security measures taken to protect Vice President Mike Pence, Trump responded, “So what?”

Based on the question, the Justice Department argues Trump cannot claim immunity from prosecution because he was acting in his private capacity as a candidate, not in his official role as a sitting president on January 6, 2021.

Prosecutors say Trump acted for personal gain. 

The document provides a detailed account of Trump’s interactions, showing he ignored advice from his aides while watching the riot unfold on TV. 

Meanwhile, Trump’s legal team plans to argue that conversations with Pence should be legally protected.

If Trump wins the 2024 election, he could direct his attorney general to dismiss the case. However, if he loses, the trial may not begin until 2026.
