Eight TikTok creators sued the US government this week over the new law mandating the sale or nationwide ban of the app if its Chinese parent, ByteDance, fails to divest stakes within nine months.

Just last week, TikTok sued the government to block the law.

Filed in a Washington appeals court, the TikTokers’ lawsuit is led by the same firm that previously challenged Montana’s TikTok ban, blocked by a judge last year.

The plaintiffs, each with millions of followers, argue that President Joe Biden’s recent law violates their First Amendment rights by threatening to shut down a communication medium, devastating their businesses and online communities.

The legal challenge may reach the Supreme Court.

Meanwhile, the Department of Justice defends the law, citing national security concerns amid escalating tensions between the US and China.
